Aeroflot has halted international flights due to personal data law

Serious problems can arise with air travel from Russia to foreign countries and back, up to interruptions, according to Aeroflot’s report for 2022. noted that risks are created by the new edition of the law on the personal data of Russians.

Changes in legislation between starting March 1, 2023. They require operators working with personal information of citizens to notify Roskomnadzor in advance before transferring it abroad. Prior to this, the operator must obtain certain information from foreign counterparties – contacts (telephone numbers and postal addresses), conditions for processing personal data, etc.

After the request is received by Roskomnadzor, ten working days must pass. This period is granted to the agency to carry out checks in order to determine the level of protection of personal data in the country where it is planned to transfer them.

Aeroflot analysts point out that foreign counterparties – public authorities, individuals and companies – are not required to provide information on the rules of their work with personal data, an unpredictable factor of “goodwill” and / or economic interest in such cooperation comes into effect.

“The demonstration of goodwill is especially unlikely in states that commit hostile actions against the Russian Federation, Russian legal persons and individuals,” the airline said in a report.

As a result, flights to countries where authorities and companies refuse to meet the requirements of air carriers serving the Russian direction will be under the threat of “forced termination”.

In the fall of 2022, Roskomnadzor warned Russian companies that they should not formally deal with compliance with the new rules, which aim to “form a culture of work with personal data and their responsible treatment, aimed at unconditional respect for the rights of citizens, the security and confidentiality of their data.”
