Ads without request will be prohibited

The Federal Antimonopoly Service has proposed to ban the sending of so-called push notifications to smartphones, tablets and computers. On Thursday, March 3, the bill was submitted for public debate.

As MK has learned, this decision is due to the fact that users have recently become more frequent complaints about advertising notifications arriving on users’ electronic devices without their knowledge. Today, the legislation clearly states that the distribution of advertising on telecommunications networks (i.e. telephone, fax, mobile communications) is only permitted with the prior consent of the subscriber. or the addressee to receive it. At the same time, an ad will be recognized as broadcast without prior consent, unless its broadcaster proves that such consent has been obtained. If he does not prove this, he will be forced to immediately stop sending it to whoever turns to him with such a request.

However, with the development of information technology, the situation has become somewhat complicated. Many users have started installing online apps from various stores on their devices as they make it easier to find the right products with their help. And these apps often start sending push notifications about promotions etc. unbeknownst to the user. The FAS has decided to extend the ban on intrusive advertising to them as well. The bill defines push notifications as “short text messages that can be viewed through the use of software installed on devices, including pop-up messages.” It will therefore soon be possible to forget about their distribution.
