A new fatwa .. Paying zakat to help the brother with the costs of divorce in one case

Post a site "Islam Web" Today, Sunday, Ramadan 4, 1444, corresponding to March 26, 2023, a fatwa regarding the ruling on paying zakat to a brother to help him with the costs of divorce and"the list" And when is considered one of the debtors.

Someone sent a question that read: "Is it permissible for me to pay from the zakat money to my brother, to help him with the costs of divorce, and the list, which amounts to 300,000 Egyptian pounds, noting that he is a teacher and his salary is 3,800 Egyptian pounds per month, and he has no money at all, and he does not own anything except furniture and electrical appliances in his marital apartment Note that the marital apartment is his own, but it is an apartment in a house owned by our mother. Note that he tried to take a loan from the bank, and the bank told him I will give you 100,000 Egyptian pounds only. Is it permissible to give him zakat money? And what is the maximum amount I can give him, to help him?".

The fatwa was as follows:

فقد بيّن الله مصارف الزكاة، وحصرها في ثمانية، فقال تعالى: إِنَّمَا الصَّدَقَاتُ لِلْفُقَرَاءِ وَالْمَسَاكِينِ وَالْعَامِلِينَ عَلَيْهَا وَالْمُؤَلَّفَةِ قُلُوبُهُمْ وَفِي الرِّقَابِ وَالْغَارِمِينَ وَفِي سَبِيلِ اللَّهِ وَاِبْنِ السَّبِيلِ فَرِيضَةً مِنَ اللَّهِ وَاللَّهُ عَلِيمٌ حَكِيمٌ {التوبة: 60}. Garmon is one of these types.

Ibn Qudamah said in Al-Mughni: And the debtors – who are the debtors who are unable to pay off their debts – this is the sixth type of zakat. Accordingly; If the divorce took place and the costs of the divorce and the outstanding debts were incurred on him, and your brother owed these debts, and he did not have money to pay them off, then it is permissible for you to give your brother from your zakat what he pays all his debts with.

But if these costs and the list are not established against him until after the divorce, and he has not been divorced yet, then you do not have the right to give him anything of your zakat to pay off these expected debts, as he is not in debt unless the debts are necessary.

Al-Nawawi – may God have mercy on him – said in Rawdat al-Talibeen: The sixth category: those in debt, and debts are of three types.

The first: a debt that he owed for his own benefit, so he is given from the zakat what is spent on it with conditions…. Ah.
