Federation Council Approves Electronic Subpoena Bill

Federation Council approved a law providing for the creation of a unified register of military archives. The law was supported by 163 senators, one voted against.

Federation Council President Valentina Matvienko noted that the law had drawn many heated comments. “I believe it is our mistake as legislators not to have ensured that citizens are properly informed of the content of this law,” she explained.

On the eve of the State Duma, immediately in the second and third readings, it adopted a bill that legalizes the distribution of electronic subpoenas to persons liable for military service and introduces a ban on leaving the country until that they report to the military registration and enlistment office.

Traditional forms of issuing subpoenas are supplemented by sending by registered mail and in electronic form. Notices sent by registered mail will be considered delivered on the day of delivery if there is a courier mark on the delivery of the letter. The summons is deemed served seven days after the date of its publication in the register. From the day the summons is considered delivered, a citizen is prohibited from leaving the territory until he appears on the summons at the military registration and enlistment office. A travel ban warning will be sent to the conscript within 24 hours from the date of delivery of the summons. The conscript is required to be on the agenda of the Military Registration and Enlistment Office within 20 days. Otherwise, “temporary measures” will be applied to him: he will be prohibited from issuing loans and borrowings, registering individual entrepreneurs, real estate and cars, as well as driving vehicles. Regions will be able to put in place additional “temporary measures” against draft dodgers, in particular, limiting the receipt of payments, allowances and other support measures. Restrictions will automatically be lifted within 24 hours from the time of inclusion on the agenda or confirmation of valid reasons for non-appearance. Russians will be able to be registered and discharged from the military without personally reporting to the military registration and enlistment office “based on citizen information” contained in state information systems. Citizens registered with the army without personally appearing at the military registration and enlistment office, “if necessary”, may receive a summons “for verification of information”.
