In Kaluga, about 700,000 people were recovered from the Criminal Code for icicles that fell on a car

In Kaluga, about 700,000 people were recovered from the Criminal Code in court for ice cubes that fell on the car. It all happened on Moskovskaya Street in February last year, the joint press service of the courts of the Kaluga region reported on Tuesday, April 18.

“In February 2022, a Citroën car belonging to the plaintiff near one of the houses on Moskovsky Kaluga Street was damaged by masses of ice falling from the roof. The indicated house is managed by ZHREU No. 21, which denied any responsibility for the incident,” the press service said.

According to the Housing Code of the Russian Federation, it is the management body that is responsible for maintaining the common property of an apartment building. His tasks are to clean the roof of the house from ice, snow and icicles. In this case, the ice cubes were not removed, which caused property damage to the plaintiff.

By decision of the Kaluga District Court, the Criminal Code in favor of the plaintiff recovered material damage in the amount of 661,900 rubles, as well as the costs of damage assessment and payment of legal services in the amount of 31,000 rubles.

The Penal Code appealed the decision on appeal, but the regional court upheld the decision.
