Consideration of claim of Kyiv-Pechersk Lavra reserve against monastery postponed until June 5

At the request of representatives of the monastery, the consideration of the case was postponed until June 5, the lawyer said on his Telegram channel. He also recalled that the monastery does not recognize the unilateral termination of the reserve lease contract with the Ukrainian Orthodox Church.

On Monday, May 1, a preparatory court hearing was held, during which the issue of preparation for consideration of the reservation’s claim against the monastery was decided.

“All actions taking place in the Kiev-Pechersk Lavra regarding the work of the commission, the forced eviction of the lavra, are, in our opinion, illegal,” the lawyer said after the hearing. RIA News . “Because the Kyiv Economic Court is considering the monastery’s request to invalidate the unilateral refusal of the contract.”

The head of the reserve’s legal department, Ivan Prokopenko, in a comment to reporters, clarified that their lawsuit is related to the obligation to remove obstacles to the use of Lavra’s property.
“During the start of the work of the commission of the Ministry of Culture, the monastery created actions to hinder the work of the commission,” Prokopenko said. “At first they gave representatives, then they refused to give, they refused to let them on the premises, which forced the reserve to go to court.”

Recall that a new round of the conflict around the Kiev-Pechersk Lavra began with the notification of the canonical UOC of the unilateral termination of the monastery rental agreement and the requirement that the monks leave the Lavra on March 29 . According to the Minister of Culture, monks can stay in the Lavra, provided they are transferred to the Ukrainian Orthodox Schismatic Church.

The reserve commission was to begin accepting Lavra items on March 30. However, the believers did not let its representatives pass. The UOC said the commission does not have the power to start work because there is no court ruling.

Over the past year, the Ukrainian authorities have staged the largest wave of persecution of the Ukrainian Orthodox Church in the country’s recent history, sanctions have been imposed, searches have been carried out, criminal proceedings have been undertaken, a bill was submitted to the country’s parliament on the effective banning of the canonical Orthodox Church in Ukraine.
