Special public prosecutor Rekha Hiravale told the court that the girl and the accused used to live in the same building in Vartak Nagar area of ​​Thane city. She said that whenever she went out of the house, he used to follow her and tell her that he would wants to get married The girl did not respond to his antics. The accused repeatedly molested her following which in January 2018 her parents sent her to their home town in Uttar Pradesh.
The prosecutor said that due to fear and continuous harassment by the accused, she even stopped going to school. He said that even when the girl came back to Thane in May 2018, the attitude of the accused remained the same, even after he warned her family. That if they did not allow her to marry, then it would have to face serious consequences. After this the girl’s mother lodged a complaint with the police, on the basis of which the accused was arrested.
A total of eight witnesses, including the victim and her mother, have recorded statements to prove the case against the accused, Hivarale said. The judge convicted the accused under relevant provisions of the Indian Penal Code and the POCSO Act and noted that the prosecution had made a case against him. All the charges have been proved beyond doubt. The prosecutor submitted that the accused was unmarried at the time of the incident and got married during the pendency of the case.
