March 30, Decree of the Government of the Russian Federation dated March 28, 2023 N 493 “On the specifics of payment of pensions, other payments and social insurance against accidents at work and occupational diseases established on the basis of legislation of the Russian Federation and international agreements of the Russian Federation, entered into force, to persons living outside the territory of the Russian Federation”. The decree applies to legal relationships born from January 1, 2023.
The document states that pensions and other accrued charges, the payment of which is impossible in connection with the introduction of restrictive economic measures against the Russian Federation, can be paid to persons residing outside the territory of the Russian Federation of Russia in Russian rubles by crediting to the bank accounts opened by such persons or their representatives in credit institutions located in the territory of the Russian Federation, or in credit institutions located outside the territory of the Russian Federation. Payments will be made on the basis of a request submitted by a pensioner residing abroad or his representative. It must contain the details of the bank account to which the money will be transferred. The application can be submitted either on paper or electronically. The application can be submitted both to the Social Fund of the Russian Federation and to any territorial body of the SFR (PFR) at the choice of the pensioner.
At the same time, in the absence of the possibility of transferring pensions and other payments abroad and if the citizen does not submit an application for payment of a pension in Russia, their payment will be suspended. To start receiving a pension again, a pensioner who is abroad must: either submit the required application; or wait for the lifting of restrictive measures against the Russian Federation that prevent the implementation of payments by transferring them to recipients outside the Russian Federation to the territory of foreign states. In either case, payments resume from the 1st day of the month following the month in which the relevant circumstances occurred, with one additional payment for the full term. In the event that the measures preventing making payments outside the Russian Federation are removed at the request of the person who exercised the right to pay pensions and other payments in the territory of the Russian Federation, its payments can be made by transferring abroad.
You can withdraw from your pension. You need a passport, German documents indicating that the pension will be acquired there and a corresponding application to the Russian Social Fund (PFR). At the same time, the opponent may also postpone the receipt of a pension for several years or completely refuse to accrue it in favor of another person, fund or institution, on the basis of considerations of charity.
If a situation arises in which a pensioner cannot independently manage his own funds stored in a financial institution in Russia, you can transfer the right to manage them to a trustee. A power of attorney can be issued for one-time representation of the interests of the depositor or for the performance of certain actions, as well as for multiple use – for a long time. This document can be issued at the branch of the bank where the client is served or at the notarial department of the consular institution.
The fastest way to issue a power of attorney to Sberbank is to personally contact the branch where the deposit was made. A trustee must also be present when this document is signed. After providing the passports of the principal, trustee, passbook or deposit agreement, complete a standard form of power of attorney, which can be certified by a branch employee.
Before going to the consular office of your choice, consult its website for the list of documents required and the requirements for certifying a power of attorney. You can adapt the exemplary examples of various notarial deeds displayed here to suit your particular situation. Before visiting the notarial service, we recommend that you agree on the content of the text of the power of attorney with Russian institutions at the place of its presentation. It is important to bear in mind that depending on the organization of the process of receiving money, the list of powers directly depends. The prepared text of the power of attorney must be published on the portal of the Ministry of Foreign Affairs of the Russian Federation https://notary.kdmid.ru/ no later than 24 hours before visiting the Consulate General. Show the code you will receive after uploading the power of attorney text to the consul portal. Again, check the contents of the power of attorney carefully before signing. The document must indicate the date, place of preparation and validity of the power of attorney. The standard duration is 1 year. The power of attorney is signed by you in the presence of a consular officer and certified by him with a seal and signature. The document is issued in paper form and the Consulate General does not take care of sending it to Russia. The fact of issuing powers of attorney can be checked on the website of the Federal Chamber of Notaries of Russia.
You can obtain a certificate of SFR payments for a period of 1 to 12 months from the State Services. You will need a verified account. An electronic document signed with an enhanced qualified electronic signature from the Social Fund (SFR) will arrive in your personal account. It has the same legal value as paper and can be used in the same cases. If you need a certificate for a period of more than 1 year or wish to receive a paper document, you can obtain it personally or through a trustee in an SFR or MFC agency (you will need a passport and SNILS). In both cases, the certificate will be ready on the day of the request.
