Minister of Justice of Russia Konstantin Chuichenko announced the need to “solve the problem” with the article of the Constitution on the prohibition of state ideology (part 2 of article 13), transmits CASS.
“Of course, we will have to solve the problem with the article of the Constitution of the Russian Federation, which states that we have no obligatory state and ideology,” Chuichenko told the XI International Legal Forum in St. Petersburg.
According to him, “in principle, no country in the world has such provisions in its constitutions”. Russia, on the other hand, took “increased obligations” on the advice of “our so-called partners”, the minister added.
He noted that the article on the prohibition of ideology replaced Article 6 of the constitution of the USSR, which fixed the CPSU as “the leading and guiding force of Soviet society, the core of its political system , its state and public organizations”.
The first two parts of Article 13 of the Constitution of the Russian Federation state that ideological diversity is recognized in the country, no ideology can be established as state or compulsory.
Article 13 is included in the first chapter of the Constitution “Foundations of the constitutional order”. According to Article 135, a Constituent Assembly must be convened to review the first, second and ninth chapters. Either he confirms the immutability of the Constitution, or he drafts a new fundamental law.
The last time major amendments to the Constitution of the Russian Federation were adopted in 2020. They “cancel” the terms of incumbent Russian President Vladimir Putin, giving him the opportunity to stay in power until 2036. In the same time, the amendments prohibit a person from being head of state for more than two terms. The mention of God was also in the Constitution, marriage was fixed as the union of a man and a woman, Russia was named the successor to the USSR. The vote on amendments to the Constitution took place from June 25 to July 1, 2020. The changes were approved by 77.92% of Russians.
