The department of Rospotrebnadzor in the Moscow region won a lawsuit against the largest Russian market Wildberries, which forced buyers to pay for the return of goods of insufficient quality. The decision was made by the Podolsky City Court of the Moscow region. In turn, the market intends to appeal this decision, writes RBC.
The Rospotrebnadzor department for the Moscow region filed a lawsuit against the market operating company Wildberry LLC in early March 2023. The claim was settled on April 13. The court considered the requirement that buyers pay for the return of goods of insufficient quality as a violation of the law.
By law, if the buyer has found defects in the goods that were not specified by the seller, he has the right to demand replacement of a similar product, free removal of defects, to refuse to buy with refund, or demand full compensation for losses caused by the sale of goods of insufficient quality.
Representatives of Rospotrebnadzor believe that when selling goods at a distance, Wildberry LLC violated applicable law by charging or withholding money from buyers due to the return delivery of goods of insufficient quality.
Recall that earlier Wildberries canceled the fines of the emission points for the substitution of goods.
