The new law on electronic diaries, adopted by the State Duma on April 11 and approved by the Federation Council and the President, has raised questions among many Russians. The document deals not only with the notifications of the “Gosuslug” and a ban on leaving the country for draft dodgers, but also with a new procedure for appealing the decisions of the editorial board.

Evgeny Krylov, a lawyer from Yekaterinburg, explained in an interview with E1.RU that he will change the new law on electronic subpoenas in practice. He drew attention to the wording of the amendment relating to the delivery of subpoenas, which many interpret as follows: they can be called upon to serve by messages on the services of the State. However, according to Krylov, the government can allocate other resources for this.

According to the amendment to Article 31 of the Law, the summons is sent in electronic form to a citizen subject to conscription for military service in the manner and in the manner established by the Government of the Russian Federation, and is considered issued from the moment it is displayed in the personal account of the citizen on the corresponding information resource, in the information system. What kind of resource it will be, ‘Gosuslugi’ or not, will be determined by the government,” the lawyer stressed.

In addition, Krylov drew attention to another tricky wording in the law regarding appeals from decisions of the editorial board. Now, when you apply for court, you will have to write more papers than before.

The amendments modify the procedure for appealing decisions of the Editorial Board. Previously, the law stipulated that from the moment of referral to the court and filing of a complaint with a higher conscription commission, the conscription decision was suspended. From now on, if a citizen takes legal action, he must also ask the judge to apply precautionary measures so that this decision is suspended. It is not specified in the amendments, it is just a new algorithm of judicial appeal, concluded the lawyer.


Recall that earlier in St. Petersburg the sending of electronic summonses to the personal accounts of conscripts on the Gosuslugi portal began.
