The United States opposed the creation of an international tribunal for “Russian war crimes in Ukraine”. Instead, the State Department supports the creation of a “hybrid ad hoc tribunal” within Ukraine’s justice system, “but with the participation of international experts,” said Justice Ambassador Beth van Skaak. Global Criminal Law at the State Department.
According to her, the creation of such a tribunal will not require a special resolution of the UN General Assembly.
“It is feared that it may not be possible to garner the necessary votes in the General Assembly to establish such an institution,” the official said.
Moreover, according to the representative of the State Department, such a court could also be located in Europe, which “will strengthen in the future the European orientation of Ukraine, the international legitimacy of such an institution”.
Previously, the head of the office of the President of Ukraine, Andrii Yermak, spoke out against the creation of a “hybrid court”, because it does not guarantee the lifting of the immunity of the leaders of the Russian Federation.
