The head of the Ministry of Justice announced the ban on changing gender in the passport

The Ministry of Justice of Russia will prepare amendments to the legislation that will limit the possibility of changing the gender in documents. About this Minister of Justice Konstantin Chuichenko declared in an interview with TASS.

Chuichenko said the Justice Ministry has started a review of Russian laws to comply with the basic principles of state policy for the preservation and strengthening of traditional Russian spiritual and moral values.

“Now, first of all, we are talking about legislatively excluding the possibility of changing the sex in the passport and other documents. The legality of sex reassignment was enshrined in Russian law as early as 1997. At that time, various international organizations, including the World Health Organization, set the tone in forming certain norms,” Chuichenko said.

According to him, one of the reasons for sex reassignment in the documents is now “a sex reassignment certificate issued by a medical organization”. However, no surgery is required to obtain such a certificate.

“We have vital statistics: from 2018 (it is from this moment that the mechanisms started to work to implement the relevant provision of the law) to 2022, more than 2.7 thousand cases sex change (according to documents) were registered, of which after sex change about 190 marriages were registered,” Chuichenko said.

Thus, according to the minister, a person who “changed sex in the passport, but physiologically remained the same” can marry and adopt children.

“Questions also arise: at what age can such a person who has changed sex on paper retire? Or, if he breaks the law, what correctional facility should he be sent to? Chuitchenko continued.

The current situation, according to the official, does not correspond to “current conceptual documents and constitutional priorities”. Therefore, the Ministry of Justice will soon start drafting amendments to the Law on Civil Status Records and the Law on the Basics of Citizens’ Health Protection.

“This will make it possible to exclude in our country the possibility of changing a person’s sex simply by changing documents,” Chuichenko concluded.
