Russia’s Supreme Court has ruled that surrendering when there is a possibility of resisting is a crime punishable by up to 10 years’ imprisonment in a colony.

“Surrender does not constitute a crime unless it was voluntary, that is, it was committed knowingly with the possibility of resolutely resisting the enemy and avoiding capture”, reads the text of the project. .

It is also specified that the penalty for voluntary surrender is three to five years in prison, however, if the army goes over to the side of the enemy, then the article “Treason” is applied to him, for which he faces 20 years in prison.

In addition, a serviceman who voluntarily surrenders for the first time may avoid criminal liability if he “took steps for his release”, and also returned to the unit or place of duty or did not commit crimes in captivity.

Earlier, DPR ombudsman Daria Morozova said Ukrainian Armed Forces militants were inventing new, more sophisticated types of torture against Russian POWs.
