New Delhi: The Supreme Court on Monday ruled that it can dissolve a marriage on the ground of irreconcilability between the spouses.
A five-judge bench headed by Justice SK Kaul said that the apex court is empowered to do complete justice under Article 142 of the Constitution. Article 142 of the Constitution deals with the implementation of the orders of the apex court ‘to do complete justice’ in any matter pending before it.
The bench also comprising Justice Sanjiv Khanna, Justice A S Oka, Justice Vikramnath and Justice JK Maheshwari. The bench said, “We have held that for this court, on the basis of non-healing of a rift in a married relationship, It is possible to eliminate it.
The court gave this verdict on several petitions related to the exercise of its powers under Article 142 of the Constitution.
