Ruling on a woman making up for fasting in the presence of her husband

Question: Is it permissible for a woman to fast without her husband’s consent, if the fast is to make up for the month of Ramadan in which she broke her fast, because she was in partum period?

Fatwa text:

Praise be to God, and prayers and peace be upon the Messenger of God and his family and companions, as for what follows:

Al-Bukhari and Muslim narrated from the hadith of Abu Hurayrah that the Prophet, may God’s prayers and peace be upon him, said: "It is not permissible for a woman to fast while her husband is present without his permission". The people of knowledge have indicated that what is meant is voluntary fasting, not Ramadan fasting or any other obligatory fast. Making up for Ramadan is an obligatory fast, but since this duty is an expanded duty, it is permissible for a woman to delay it until the number of her days remains before the start of the second Ramadan for her, and this is witnessed by the case of Aisha, may God be pleased with her. I do not spend it except in Shaban, to be busy with the Messenger of God, may God’s prayers and peace be upon him. That is why some people of knowledge have issued a fatwa that a woman should not fast to make up her days except with her husband’s permission, because this time is not specified in her right. God only knows.
