The Egyptian Parliament approved, during its plenary session yesterday, headed by Counselor Dr. Hanafi Jabali, in all its articles, a draft law submitted by the government to amend some provisions of Law No. 26 of 1975 regarding Egyptian nationality.
The draft law aims to grant minor children the Egyptian nationality to a foreign mother, whether she acquired the Egyptian nationality or was born in Egypt and belongs to a country whose language is Arabic or whose religion is Islam, in order to achieve the principle of equality between men and women alike, in acquiring the Egyptian nationality for children, provided that the law defines conditions acquisition of nationality.
According to Egyptian media, Parliament Speaker Hanafi Jabali said during the plenary session yesterday that the final approval will be postponed to another session.
The counselor explained that the draft law came in implementation of the ruling of the Constitutional Court, which ruled that the text of the second paragraph of Article (6) was unconstitutional, as it included limiting the right to acquire Egyptian nationality for minor children in the case of a foreign father acquiring this nationality, without the case of a foreign mother acquiring it, and in that he said Jabali: " Acquisition of nationality is a manifestation of state sovereignty, in which the state enjoys wide discretionary power to accept or reject the application, all of which is under the supervision of the judiciary."noting that "All cases of acquiring nationality are subject to the discretionary authority and there is no authority over it in that, because nationality is a principle that affects the sovereignty of the state"
For his part, Deputy Major General Yahya Kadwani, member of the Defense and National Security Committee, reviewed the report of the joint committee from the Defense and National Security Committee and the Office of the Constitutional and Legislative Affairs Committee on the two draft laws submitted by the government for some provisions of Law No. 26 of 1975 regarding Egyptian nationality, pointing out that the draft law aims to Also, enhancing opportunities for obtaining foreign exchange by facilitating the procedures for granting Egyptian nationality, which includes permitting the granting of Egyptian nationality to a foreigner who buys real estate from the private sector, after completing all the data and documents required by the Naturalization Applications Examination Unit, and estimating the fees for the application to obtain Egyptian nationality.
