Russia has failed to comply with more than 2,000 ECHR judgments

The Council of Europe published its annual report on Thursday on the implementation by its member countries of the decisions of the European Court of Human Rights.

Last March, Russia was expelled from the Council of Europe because of its aggression against Ukraine. On September 16, it officially ceased to be a party to the European Convention on Human Rights. However, the Council of Europe stresses that it is obliged to comply with the decisions of the ECtHR in cases accepted by the Court for examination before September 16, 2022. Moscow, however, in March last year, ceased both to implement ECHR decisions and to report on their implementation.

As noted by the Council of Europe, at the end of last year more than 6,000 decisions of the European Court of Human Rights had to be executed, of which 2,352, or around 40%, were Russia. The Council of Europe’s Committee of Ministers, which monitors the execution of court decisions, received 413 new ECHR decisions last year, of which only three were executed.

Russia should pay compensation according to the ECHR decision in 1102 cases, and the total amount of compensation not paid by the Russian authorities exceeds 2 billion euros, including more than 1.8 billion in compensation in the case Yukos and 10 million in Georgia v. Russia.

Last June, Russian President Vladimir Putin sign the law adopted earlier by the State Duma on the non-enforcement of decisions of the European Court of Human Rights issued after March 15, 2022. Document published on the official legal information portal.

ECtHR last year, in particular, ruled in favor of the Russian Jehovah’s Witnesses, recognizing the recognition of this organization as extremist and the criminal prosecution of its supporters as a violation of human rights.

In January 2023, the court ruled that its jurisdiction allowed it to consider complaints about events in the Donbass since 2014, including when considering claims related to the crash of the Malaysian Boeing.
