BEIJING — A contractor who orders a Chinese-built tunnel boring machine for delivery after Nov. 18 will have to find out whether its country counts as “disputed” with Beijing, and the notice that raises the question never answers it.
The Ministry of Commerce and the General Administration of Customs published the rules on Monday as Announcements 50 and 51, alongside a separate drone notice co-signed by the Central Military Commission’s Equipment Development Department. Xinhua’s English report names tunnel boring machines and dredger items and gives the same Nov. 18 start.
The Chinese text sets two tiers. Exporters selling to “sensitive countries and regions that have disputes with China,” in TEH’s translation, must apply for a license and may not ship without one. Everyone else gets an export certificate by registering, with exporter and end user promising not to pass the machines to those places without a license. Nothing in the notice defines a dispute or names a country.
That is the stake: the test is political rather than technical, and the ministry keeps the judgment for itself. According to Announcement No. 50, the list covers every full-face tunnel boring machine, soil, slurry or rock, with no diameter threshold, plus cutterheads, screw conveyors, segment erectors and main drives. It also reaches two classes Xinhua’s English report does not itemize: walking excavators that can clear a vertical obstacle higher than 1.2 meters, among other tests, and high-altitude wet-spraying machines built for work above 3,000 meters.
The missing size cutoff matters because the machines keep growing. CGTN reported on Sept. 15 that a 16.68-meter machine, China Railway 1662, weighing about 4,800 tonnes, had rolled off a line in Zhengzhou. Nothing in Monday’s text sets a size below which a machine escapes.

A ministry spokesperson, quoted by Xinhua, said the items are clearly dual-use, that China’s implementation “conforms to international practices,” and that applications “that meet requirements will be approved.” Customs can query a declaration it doubts and will not release the cargo meanwhile, and Announcement 52 gives exporters seven working days to produce documents.
The drone and dredger notices are adjustments. The ministry says some once-advanced drones are now consumer products. TEH did not compare the new thresholds with the old list and cannot say who gains. It is the ministry’s second export-control step in three days, after Friday’s order on AI export registration.
Which countries Beijing counts as disputed, and how many machines now go to them, are not in any document published Monday. TEH found no export figures in the sources it read.
