Digital call. Electronic Subpoenas Law Questions and Answers

The State Duma adopted in the second and third readings a draft law on electronic subpoenas, which also provides for “restrictive measures” for scammers. Some MPs criticized the haste with which the document was considered, but it was adopted anyway. The Eastern Herald has collected answers to all questions that Russians may have in connection with innovations.

What is the invoice about?

If the bill passes as it currently stands, receiving the subpoena will be considered lawful if:

whether the summons was delivered personally to an employee of the military registration and enlistment office against signature, or through an employer or an educational institution; if the invitation was sent by registered mail with acknowledgment of receipt. The summons shall be deemed served in the laziness of its reception or of its refusal to receive it; whether the agenda was posted in the personal account on the “Gosuslugi” or in the “Unified Register of Agendas”. It will be considered delivered as soon as it is posted on the portal.

In all cases, the summons will be considered served 7 days after its publication in the register of summonses. An extract thereof can be obtained in your account on the registry operator’s website, at the MFC or on the Gosuslug portal. At the same time, MFC will notify military registration and enlistment offices of such requests.

There is no information yet on when the Unified Subpoena Registry will be created. The register will be managed by the Ministry of Defense and the Ministry of Digital Development. In November 2022, Vladimir Putin instructed the Ministry of Digital Development to create a centralized database of all Russians eligible for military service by April 1, 2024.

The bill also provides for the introduction of “provisional measures” for deviants – those not on the agenda within 20 days from the date specified by the military registration and enlistment office. . According to the decision of the military commissioner, which will be issued automatically, deviants may restrict the right to:

leave the territory of the Russian Federation; registration of real estate in the property; vehicle control; registration as an individual entrepreneur or self-employed person; vehicle registration; receive credits and loans.

The authorities of the subjects may also introduce additional temporary measures, for example restrictions on the receipt of regional payments, benefits and other support measures.

Restrictions will be lifted automatically by decision of the Military Commissioner within 24 hours of appearance on summons or provision of information on a valid reason for non-appearance.

The head of the State Duma Committee on Defense, Andrei Kartapolov (United Russia), pointed out that the draft law on electronic summons refers to all those who are liable for military service, and that the new rules will also apply to those in reserve. At the same time, the innovations will not apply to those mobilized, since a new wave is not expected, the MP said.

Nina Ostanina (KPRF), chairwoman of the State Duma Committee on Family, Women and Children, said that “the stupidity and mistakes” that took place during the partial mobilization “affect until this day”. At the same time, the bill, she says, will affect the entire male population, not just recruits. Moreover, the bill needs serious improvements, Ostanina believes.

“If it is a partial mobilization, then make a clear note: one, the other and the third are subject to partial mobilization, but at the same time, one, the other and the third are also exempt from partial mobilization. Another declaration: we will not have a new wave of mobilization. Why then are you in a hurry with this law now? ” – she says.

“We were in a rush, because the Federation Council meets tomorrow, after that they won’t meet for another month. If there is such an emergency law that prevents the Federation Council from meeting and adopting it urgently, but carefully, carefully checked to the letter, so that it does not hit anyone on the one hand, but on the other hand, would it be understandable for everyone? “says Ostanina.

Deputy Aleksey Kurinny (KPRF) in an interview with The Eastern Herald pointed out that the adoption of the bill in its current form could lead to the fact that citizens who “for objective reasons will not be able to see in time that they are registered on the register of conscripts ” will be held responsible for the escape.

“I do not rule out that someone will start to leave state services, even if it will not save, because there is an electronic register, which citizens will now apparently have to follow. It is not quite ready yet. made clear how it will work. The system has not been created, and there is a reference in the law that it will be done in separate terms,” he said.

Kurinny did not rule out that in the context of the bill’s passage, “there will be another wave of some panic.” At the same time, he believes that “those who wanted to leave have already left, and the others want clear normal rules”.

The first deputy chairman of the Defense Committee of a State Duma deputy Andrei Krasov (United Russia) stressed in a conversation with The Eastern Herald that the bill is not connected with a new wave of mobilization.

“It was a systematic approach to eliminate the shortcomings associated with military accounting. <...> This will ensure the transparency and efficiency of military records. There will be no problematic issues that we faced in the fall of 2022,” he said.Member of the Defense Committee Deputy Andrey Gurulev (United Russia) explain in his telegram channel that the rapid adoption of the bill is important to correct the errors of the first wave of partial mobilization.

“What will it bring us? First, the less military training people have, the less our enemies will want to start conflicts against Russia. Secondly, the system is being gradually automated, this will greatly simplify everyone’s life – there will no longer be a need to run to the military registration and enlistment office to notify each step. <...> If you are a law-abiding citizen, this law will not change your life in any way. If you are an escapee then it is time for you to stop being one,” he wrote.

How was the bill passed?

The bill on amending the Federal Law “On military service and military service” was first proposed in the State Duma in January 2018. It began to be considered, but a year later, it was postponed. The bill passed second reading, as amended, on April 10, 2023.

State Duma Deputy Nikolai Kolomeytsev (KPRF) during a parliamentary session declared on the violation of regulations during the consideration of the bill on electronic subpoenas. His objection was supported by MPs Alexei Kurinny (KPRF) and Artem Prokofiev (KPRF).

“The changes were made at 1:00 p.m. – they contain dozens of pages of text. Maybe it will be an important tool to fight the deviationists, but why do it? says Kolomeitsev.

In response to an objection, State Duma Chairman Vyacheslav Volodin suggested that Alexei Kurinny “join the army and stand shoulder to shoulder with the army, and not sabotage the consideration of the project of law”.

State Duma Deputy Dmitry Vyatkin (United Russia) told The Eastern Herald that all the procedures for the adoption of the bill were followed and the deputies had time to familiarize themselves with the text of the document.

“All representatives of all factions were among the co-sponsors. The Committee (of the State Duma on Defense) passed a few days ago. All the procedures were followed, and if one of the colleagues was too lazy, didn’t read something, then got indignant – well, sorry,” he said.

Nina Ostanina (KPRF) noted in a conversation with The Eastern Herald that the bill is being rushed through. According to her, she and other deputies did not have time to study the document in detail, while its content has changed a lot since the first reading.

“It’s not so much about the content of the bill itself, but about the form of its presentation, the lack of dialogue. <…> You need to understand what you are voting for. I did not understand what my colleagues voted for today. I had questions, they remained unanswered. <...> And judging by the changes that took place after the amendments, this is a completely different bill, which differs from the one we passed at first reading,” Ostanina stressed.According to the State Duma, Nina Ostanina and Alexei Kurinny did not accept participation in the vote on the adoption of the bill. Nikolai Kolomeytsev, who declared rule violations, voted in favour.
