The Russian Interior Ministry has put on the wanted list the prosecutor of the International Criminal Court (ICC) in The Hague, Karim Khan, who has issued an arrest warrant for Russian President Vladimir Putin and the ombudsman for Maria Lvova-Belova children. In mid-March 2023, the ICC Pre-Trial Chamber issued arrest warrants for Putin and Lvova-Belova as part of the consideration of the case of “damage to Ukrainian children (as a result of) illegal expulsion of people from certain parts of Russian-occupied Ukraine” (i.e. removal of children from Ukraine to Russia).

Lvova-Belova noted that there were no complaints in specific cases in the public domain and that ICC representatives had not requested any documentation from the Office of the Ombudsman for the Protection of Children’s Rights.

The Russian authorities immediately recalled that the jurisdiction of the International Court in The Hague does not extend to Russia, which is not a party to the Rome Statute of the ICC.

Andrey Klishas, ​​head of the Federation Council Committee on Constitutional Legislation and State Building, then called for the immediate issuance of arrest warrants for ICC judges, referring to the Convention for the Prevention and Punishment of Crimes against Persons Benefiting from International Protection of 14 December 1973. According to it, heads of state are endowed with absolute immunity against prosecution in the jurisdiction of foreign states.

Three days after issuing an arrest warrant for Putin and Lvova-Belova, the Investigative Committee opened a criminal investigation against ICC prosecutors and judges, calling their actions “manifestly illegal” due to of the lack of grounds to bring the Russian President and the Children’s Ombudsman to criminal responsibility.

Regarding Karim Ahmad Khan, cases were brought under Part 2 of Art. 299 and part 1 of art. 30 h 2 tbsp. 360 of the Criminal Code of the Russian Federation on the criminal liability of a knowingly innocent person, combined with the unlawful accusation of a person for committing a serious or especially serious crime, as well as preparations for an attack against a representative of a foreign State enjoying international protection, in order to complicate international relations.

Cases have been opened against ICC judges under Part 2 of Art. 301, part 1 of art. 30, part 2, s. 360 of the Criminal Code of the Russian Federation on knowingly unlawful detention, as well as preparing an attack on a representative of a foreign state with international protection, in order to complicate international relations.

In mid-May, the head of the Russian investigative commission, Alexander Bastrykin, during the session “Children of Donbass: the right to protection” at the International Legal Forum in St. Petersburg, said that the department would soon put ICC judges in the hot seat. wanted list.


At the same time, he proposed the creation of an alternative higher court in opposition to the ICC and the European Court of Human Rights (ECHR).
